The petitioner is accused in connection with Gardanibagh P.S. Case No. 383 of 2012, registered under Section 414 of the Indian Penal Code and under Section 21 and 22 of the NDPS Act.

Learned counsel appearing on behalf of the petitioner submits that the prayer for bail of the petitioner along with other co-accused were rejected twice on 17.01.2014 vide Criminal Miscellaneous No.37383 of 2013 and on 02.12.2015 vide Criminal Miscellaneous No. 50731 of 2015. Further submission is that petitioner is in custody since 10.12.2012 and up till now, out of seven chargesheet witnesses, only one witness has been examined. Patna High Court Cr.Misc. No.23883 of 2016 (2) dt.22-06-2016 2/2 to be the driver of the said vehicle in which 08 packets each containing 10 kg. of Ganja had been recovered. Further submission is that similarly situated co-accused, Munna Alam has already been granted privilege of bail by this Court vide order dated 11.05.2016 passed in Criminal Misc. No. 20416 of 2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge-VII, Patna in connection with Special Case No. 45 of 2012 (Gardanibagh P.S. Case No. 383 of 2012).
