The petitioner seeks bail in a case under Section 302/34 of the Indian Penal Code and section 27 of Arms Act. The informant named 12 persons and alleged that they all surrounded his house and Santosh Singh, Vishwanath Singh and Babloo Singh made indiscriminate firing but due to firing by Santosh Singh his wife got injury on her chest and she died on the spot.

It is submitted that Babloo Singh, Subhash Singh, Ram Singh and Nand Kishore Singh @ Anand Kishore Singh have already been enlarged on bail vide orders passed in Cr. Misc. Nos. 8343/ 2015 and 9397 of 2015. There is no allegation of firing against the petitioner.

Patna High Court Cr.Misc. No.28663 of 2015 (2) dt.06-08-2015 2/2 Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in Mansi P.S. Case No. 191/2014.
