Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 338, 326 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation against the petitioner is that he made firing in the air in a Tilak ceremony causing grievous injury on the eye of the injured, Sona Devi.

Submission on behalf of the petitioner is that petitioner is in jail custody since 23.02.2016 and moreover, the rifle, which is said to have been used in the present occurrence,

Patna High Court Cr.Misc. No.23823 of 2016 (3) dt.13-07-2016 2/2 was seized and one Satendra Singh was licensee of the aforesaid rifle. It is further submitted that moreover, parties have already compromised the case.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Bikramganj, Rohtas in connection with Karakat P.S. Case No. 37 of 2016.
