The petitioner in custody since 06.05.2015, seeks bail in case registered for offences punishable under Sections 341, 324, 307, 504, 506/34 of the Indian Penal Code and 27 of the Arms Act.
The prosecution case is that the informant gave his fardbeyan before the Officer-in-charge of Pachrukhi (G.B.Nagar) P.S. to the effect that on 5.5.2015 at about 8.30 P.M. the informant alongwith other persons while returning after marriage negotiations from Siwan reached Tarwaha and enquired about the Bharatpura. In the meantime Thakur Amarjeet Singh (petitioner), Manto Singh, Rakesh Pandey and one unknown person came there
Patna High Court Cr.Misc. No.29147 of 2015 (2) dt.05-08-2015 2/2 and tried to snatch the mobile of the informant and abused. On protest, the petitioner fired from his gun which hit on both legs and the leg of villager namely Ram Ashish Yadav. The informant was brought to the Sadar Hospital, Siwan for treatment and his statement was recorded before the police in the Hospital. It has been submitted by the learned counsel for the petitioner that the injury received by the injured, are simple in nature which is evident at Annexure-3.
Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional judicial Magistrate, Siwan in connection with Panchrukhi (G.B. Nagar ) P. S. Case No. 111/2015.
