JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-302, 394/34 of the Indian Penal Code and under Section27 of the Arms Act. Petitioner has disclosed at paragraph-3 of the petition that prior to institution of the present case, only one case i.e. Durgawati P.S. Case No. 35 of 2014 had been registered against him but paragraph-48 of the case diary, goes to show that altogether 12 cases had been lodged against him in different districts of Uttar Pradesh and the aforesaid fact has been suppressed by the petitioner.

Learned counsel, appearing for the petitioner submits

Patna High Court Cr.Misc. No.23176 of 2016 (3) dt.12-07-2016 2/2 that in paragraph-3, the information regarding the antecedent of the petitioner has been made on the basis of information, furnished by the Pairvikar of the petitioner.

Since the petitioner attempted to suppress the facts, therefore, I am not inclined to release him on bail and accordingly, his prayer for bail in connection with Mohania P.S. Case No. 50 of 2014 corresponding to Sessions Trial No. 104 of 2016/12 of 2016 pending in the court of learned Sessions Judge, Kaimur at Bhabua stands rejected.
