JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-11-2022 After some argument, learned counsel for the petitioners seeks permission to withdraw this anticipatory bail petition, so far as petitioners no. 2, 3, 4 & 5 are concerned, granting liberty to them to surrender before the court below and make a prayer for regular bail.

Permission is accorded.

The petition, with regard to petitioners no. 2, 3, 4, & 5, stands dismissed as withdrawn with liberty to surrender before the court below within a period of six weeks from today

Patna High Court CR. MISC. No.35086 of 2022(2) dt.01-11-2022 2/2 and pray for regular bail. If within stipulated time, they surrender, the learned court below, without being prejudiced by this order, shall examine the same on its own merit and pass appropriate order in accordance with law.

So far as petitioner no. 1 namely Rajdev Yadav is concerned, since there is no allegation of firing against him and he is only alleged to have caught legs of the deceased, he (petitioner no. 1), in the event of their arrest/surrender within a period of six weeks from today, is directed to be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Buxar in connection with Dumraon (Naya Bhojpur O.P.) P.S. Case No. 446 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. The bail application is, accordingly, disposed of.
