The petitioner seeks bail in anticipation of his arrest in connection with Patepur P.S. Case No. 38 of 2021 dated 19.02.2021 instituted for the offences under Sections 147, 148, 149, 341, 323, 325 and 307 of the Indian Penal Code. Though the accusation against the petitioner is of having given a sword blow on the face of the informant but the injuries suffered by him have been opined to be simple in nature.

There is a counter version of the occurrence also lodged by the brother of the petitioner vide Patepur P.S. Case No. 35 of 2021 in which it has been alleged that on 16.02.2021,

No.44344 of 2021(2) dt.29-04-2022 2/2 the informant of the subject FIR was found damaging the CCTV installed outside the shop of the petitioner, in order to facilitate the act of theft and when this was objected, the petitioner and others were assaulted which led to injuries on the person of the petitioner as well.

Considering the afore-noted background facts and taking into account that the petitioner does not have criminal antecedents, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Patepur P.S. Case No. 38 of 2021, subject to the conditions as laid down under Section 438(2) Cr.P.C.
