1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Mithanpura P.S. Case no.69 of 2024 registered under sections 420 and 406 of the Indian Penal Code.

3. As per the prosecution case, the informant states that the vehicle/car in question belonging to the informant was given to one driver Mitrunjay Jaiswal for driving the same. However, subsequently the said accused stopped receiving the telephone call of the informant and the informant's vehicle also disappeared.

4. It is submitted by learned counsel for the petitioner that the petitioner is not named in the FIR. His name transpired in the confessional statement of the accused

Patna High Court CR. MISC. No.39473 of 2024(2) dt.03-06-2024 2/2 Mritunjay Kumar, according to which he had sold the vehicle in question to this petitioner for a sum of Rs. 2 lakhs. It is submitted that at best the allegation against the petitioner is that he did not properly verify the ownership of the vehicle in question before paying a sum of Rs.2 lakhs for purchasing the same. The petitioner is in custody since 24.3.2024 and has no criminal antecedent. He undertakes to cooperate in the trial.

5. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the nature of allegations against the petitioner in the F.I.R., his being in custody since 24.6.2024 and not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Mithanpura P.S. Case no. 69 of 2024 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class (East), Muzaffarpur.
