This application has been filed for grant of regular bail in connection with Patahi P.S. Case No. 162 of 2022 registered for the offence under Sections 341, 323, 384 and 120 B of the Indian Penal Code.
As per the prosecution case, while the informant was cultivating his land, all the accused persons along with the petitioner came and assaulted the informant and demanded Rs. 5,00,000/- as extortion money.
Learned counsel for the petitioner submits that both the parties are pattidars and due to land dispute between the parties this false case has been lodged against the petitioner. The petitioner has no criminal antecedent and he is in jail
Patna High Court CR. MISC. No.35585 of 2023(2) dt.07-07-2023 2/2 custody since 03.04.2023. Similarly situated co-accused persons have been granted anticipatory bail vide order dated 15.05.2023 by a coordinate Bench of this Court in Cr. Misc. No. 11637 of 2023.
Learned APP for the State has opposed the prayer of bail.
Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Patahi P.S. Case No. 162 of 2022.
