JUSTICE AHSANUDDIN AMANULLAH ORAL JUDGMENT Date : 26-09-2019 Heard learned counsel for the petitioner and learned AAG 12 assisted by learned AC to AAG 3 for the State.

By order dated 02.09.2019, successive Superintendents of Police, Madhubani, who were holding such post since 20.07.2016, i.e., the date of passing of the order in Cr WJC No. 213 2016, were called for reasons recorded in the order. Today, they are present and have filed their separate show cause.

3. Upon going through the same, the Court finds that ultimately the purpose of the order has been served and there was re-investigation but, that too, resulted in there being no evidence

Patna High Court MJC No.744 of 2018 dt.26-09-2019 2/2 available against the accused of Benipatti PS Case No. 211 of 2015 and accordingly again final form has been submitted.

4. The present Superintendent of Police, Madhubani informed the Court that against the final form submitted, the petitioner has also filed protest, which is pending.

5. Having considered the matter, the Court finds that there ought to have been more seriousness and promptness shown by the officers, but ultimately as things have moved and now in accordance with law, things are required to be taken to their logical conclusion and the petitioner also having filed protest against the final form submitted against the accused, nothing further remains in the present application. Accordingly, the same stands disposed off.

6. Personal appearance of the officers stands dispensed with.
