The petitioner has preferred this application for grant of regular bail in a case registered under sections 272 and 273 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 117 litres of liquor was recovered from the bushes behind the school. It transpired that the three accused persons including the petitioner herein were involved in the trade of liquor .

It is submitted by learned counsel for the petitioner that neither the petitioner was arrested at the spot nor any incriminating article has been recovered from his possession. He

Patna High Court CR. MISC. No.46227 of 2021(2) dt.03-02-2022 2/2 has no concern either with the seized liquor or with the place of alleged recovery. The cause of his false implication is his antecedents. The petitioner is in custody since 15.6.2021 and charge sheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner not being arrested at the spot and having remained in custody for more than 7 months, the Court directs the petitioner to be enlarged on bail in connection with Kathaiya P.S. Case no. 186 of 2019 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Muzaffarpur.
