The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 366A and other ancillary sections of the Indian Penal Code. As per the prosecution case, petitioner and his accomplice kidnapped minor daughter of the informant to use her in the flesh trade.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. The victim, in her statement recorded under Section 164 Code of Criminal Procedure has stated that she left her house out of her own will and she was in love with the petitioner. Age of the victim has been assessed to be 17

Patna High Court CR. MISC. No.44400 of 2021(3) dt.03-01-2022 2/2 years by the Court below. Petitioner has claimed clean antecedent and he is in custody since 2.5.2021. Charge sheet has already been submitted.

Considering the aforesaid facts and circumstances of the case and the statement of the victim, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge VI cum Special Judge, POCSO Act I, Muzaffarpur in Gaighat Police Station Case No. 178 of 2021.
