The petitioner is languishing in custody since 14.8.2014 in a case registered for the offences punishable under sections 399, 402, 414, 420, 467. 468. 471, 353, 307 of the Indian Penal Code and 25(1-b), 26, 27 of the Arms Act and 20, 22 of the N.D.P.S.Act.

Prosecution case is that on information being received that 7-8 made a plant to commit dacoity, the raid was laid leading to arrest of 11 persons and from different persons arms, Charas and Ganja was recovered. From the possession of the petitioner one country made pistol and five live cartridges and 1/2 Kg. charas were recovered.

It is submitted by the learned counsel for the petitioner that the recovery of charas is between small and commercial

Patna High Court Cr.Misc. No.24762 of 2016 (4) dt.05-08-2016 quantity. The petitioner has been booked after the registration of the present case in five cases by the police mostly registered under section 395 of the Indian Penal Code.

Considering the nature of recovery and the petitioner being involved in five other cases mostly registered under section 395 of the Indian Penal Code, this Court is not inclined to grant bail to the petitioner, at present.

This application is, accordingly, dismissed.
