JUSTICE SATYAVRAT VERMA ORAL ORDER 10-12-2021 The present petition has been taken up for consideration through the mode of Video Conferencing in view of the prevailing situation on account of Covid 19 pandemic, requiring social distancing.

Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Excise Case No. 104 of 2021, registered under Sections 30 (a) of Bihar Prohibition and Excise (Amendment) Act, 2018. Learned counsel for the petitioner submits that the petitioner is in custody since 27.03.2021 as mentioned in para 11 and is a person of clean antecedent and prosecution report has been submitted. Learned counsel submits that allegation is

Learned counsel submits that the recovery was made from the place near the house of the petitioner and the petitioner came to be implicated that on suspicion who was indulging in illegal liquor trade.

Learned APP for the State opposes the prayer of regular bail application of the petitioner.

Considering the fact that the petitioner is in custody since 27.03.2021, Prosecution report has been submitted in this case, Learned counsel submits that the petitioner, is a person with clean antecedent and no concern with that, let the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, 2nd cum Special Judge, Excise, Rohtas at Sasaram in connection with Excise Case No. 104 of 2021.
