The petitioner has preferred this application for grant of regular bail in a case registered under section 392 of the Indian Penal Code.

As per the prosecution case, three accused persons on a motorcycle dashed the motorcycle of the informant as a result of which he fell down and they took away his motorcycle. It is submitted by learned counsel for the petitioner that the F.I.R. was registered against three unknown. Referring to the order of the learned trial court rejecting the application for bail of the petitioner, it is submitted that the name of the petitioner transpired in the confessional statement of co-accused Deepak Kumar made before police. Patna High Court CR. MISC. No.45731 of 2021(2) dt.01-02-2022 2/2 himself been enlarged on bail vide order dated 13.12.2021 passed in Cr. Misc. no.38133 of 2021. The petitioner is in custody since 8.1.2021 and has no criminal antecedent. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the grant of bail to the co-accused Deepak Kumar on whose confessional statement before the police, the name of the petitioner transpired and the petitioner having remained in custody for more than 1 year, the Court directs the petitioner to be enlarged on bail in connection with Town Hajipur P.S. Case no.859 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur.
