JUSTICE SUDHIR SINGH ORAL ORDER 09-08-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 25 (1-b) a, 26 and 35 of the Arms Act. Allegation against the petitioner is that one loaded pistol along with one cartridge was recovered from his possession. It has been submitted on behalf of the petitioner that he is in custody since 19.8.2015. Chargesheet has been submitted against the petitioner. No allegation of tampering of witnesses is alleged against the petitioner. As per the F.I.R., one loaded country made pistol along with one cartridge is said to have been recovered from the possession of the petitioner. There is no compliance of Section 100 Cr. P. C.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

No.25443 of 2016 (3) dt.09-08-2016 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra, in connection with P.S. Case no. 134 of 2015.
