2. The petitioner seeks bail in connection with Sultanganj P.S. Case No. 306 of 2024 registered for the offence under Section 103(1), 3(5) of the BNS, 2023 and under Section 27 of the Arms Act.

3. As per the prosecution case, the informant has alleged that he received an information that his elder brother was shot by some unknown miscreants. Subsequently, he went to PMCH and saw the dead body of his brother. The petitioner is in custody since 16.12.2024.

4. It has been submitted by the learned senior

No.34479 of 2025(6) dt.12-11-2025 2/3 counsel for the petitioner that the petitioner was not named in the FIR and subsequently, the brother of the deceased, who is the informant of the case, has named the petitioner has one of the accused. He further submits that there is no direct evidence against the petitioner of having committed the crime.

5. Learned senior counsel for the petitioner has produced a copy of the order sheet dated 11.07.2025 passed in Cr. Misc. No. 35041 of 2025 to show that one of the co-accused namely Rajat Kumar Sharma has already been granted bail.

6. Considering the aforesaid facts, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court of Sub-Divisional Judicial Magistrate, Patna City, Patna/concerned Court below in connection with Sultanganj P.S. Case No. 306 of 2024, subject to the condition that both the bailors should be parents/brother of the petitioner.

8. As a condition of this order, the petitioner after being released on bail is directed to mark his attendance at Sultanganj Police Station on every Sunday of each month. Any default in appearance at the police station will result in

9. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.

10. As a condition of this order, the petitioner, after being released on bail, if found tampering with the evidence then his bail bonds shall be cancelled by the Court below. (Sandeep Kumar, J) Vikas/- U
