Petitioner seeks bail in connection with Gopalpur P.S. Case no. 376 of 2020 registered for the offence punishable under section 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is in custody since 11.1.2021 and charge sheet has been submitted. Learned counsel for the petitioner further submits that the informant in the FIR alleges that Ravindra Paswan driver of the truck had to deliver Patanjali products worth Rs 9 lac at Aurangabad but the goods were not delivered where it had to be delivered and when the informant contacted the driver, his phone was switched off. Learned counsel submits that during course of investigation it transpired that driver had

Patna High Court CR. MISC. No.44256 of 2021(2) dt.14-12-2021 2/2 committed theft of the goods which he was carrying and the some of the goods were recovered from the house of the petitioner. Learned counsel submits that petitioner had given his premises on rent to one Sagar Rai on monthly rent and when the petitioner came to be implicated in the present case, he realized that Sagar Rai in connivance with Ravindra Paswan had kept Patanjali products in his premises.

Learned APP opposes the prayer for bail.

Considering the facts that petitioner is in jail custody and charge sheet has been submitted, the petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate IX, Patna in Gopalpur P.S. Case no. 376 of 2020.
