====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 25-11-2025 Heard learned counsel for the petitioner as well as learned APP for the State.

2. The petitioner apprehends his arrest in connection with Shikarpur P.S. Case No. 356 of 2025, registered for the offences punishable under Sections 126(2), 115(2), 109, 329(4), 352, 351(2), 3(5) of BNS and 25(1-a), 25(g), 27 of Arms Act.

3. The petitioner and the informant are own brothers. According to allegation, the petitioner fired at the informant but he was saved. He also fired second time but the cartridges missed.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated. He is a person of clean antecedent. There is case and counter case.

5. On the other hand, the learned APP for the State and

Patna High Court CR. MISC. No.35846 of 2025(4) dt.25-11-2025 2/2 the learned counsel for the informant have opposed the prayer for bail.

6. The Hon'ble coordinate Bench, vide order dated 18.06.2025, called for the video clip and original case diary of Shikarpur P.S. Case No. 356 of 2025 (the present case). The same has been received. The video clip was played in the Court and in the video clip, there is no evidence of firing.

7. Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Bettiah, West Champaran in connection with Shikarpur P.S. Case No. 356 of 2025, subject to the conditions as laid down under Section 438(2) Cr.P.C.
