The petitioner apprehends his arrest in Excise Spl. Case No.2917 of 2019 arising out of Nadi P.S. Case No.69 of 2019 registered under Section 30(a) of Bihar Prohibition and Excise Act.

The petitioner is the owner of the Scorpio bearing registration No.BR-31D-2378 and 144 liters of liquor was recovered from the Scorpio.

The learned counsel for the petitioner submits that petitioner is of course the owner of the vehicle but he had given the vehicle on hire but it appears that vehicle is not commercial one.

Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail.

Patna High Court CR. MISC. No.33095 of 2019(2) dt.20-05-2019 2/2 Accordingly, the same is rejected.

The learned counsel for the petitioner after dictating the order came and said that the vehicle is commercial. There is nothing on record to show that the vehicle is commercial. It appears from the fact that it was the petitioner, who being the owner of the vehicle, was indulged in illegally transporting the liquor.
