The petitioner seeks bail in anticipation of his arrest in connection with Narpatganj P.S. Case No. 137 of 2016 dated 02.06.2016 instituted for the offences under Sections 147, 148, 149, 341, 323, 324, 325, 307 and 379 of the Indian Penal Code and under Section 27 of the Arms Act.

Learned counsel for the petitioner has drawn the attention of this Court to the fact that in the FIR, the allegation against the petitioner and one Bipin Yadav is of assaulting the father-in-law of the informant. Learned counsel for the petitioner has also

No.33603 of 2020(2) dt.15-03-2021 2/2 submitted that there is a counter version of the occurrence and after the investigation of the present case, other accused persons were sent up for trial except the petitioner and aforesaid Bipin Yadav. However differing with the police report, cognizance has been taken against the petitioner also. Some of the other accused persons of this case have also been granted anticipatory bail which fact has been stated in the petition.

Considering the aforestated facts, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, on his furnishing bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-III, Araria in connection with Narpatganj P.S. Case No. 137 of 2016, subject to the conditions as laid down under Section 438(2) Cr.P.C.
