The petitioner seeks bail in a criminal prosecution registered under Sections 364, 366-A and 120(B)/34 of the Indian Penal Code.
Though, the petitioner, is named in the first information report vide Annexure-1 as an accused with an allegation of kidnapping the minor daughter of the informant, namely, Sudha Kumari, but taking into consideration the fact that the alleged victim girl Sudha Kumari has been recovered and her statement under section 164 of the Code of Criminal Procedure, 1973 was recorded on 10.03.2016, which has been brought on record as Annexure-2, wherein she has given a complete go-by to the entire prosecution version and has claimed to be major aged about 19 years, and further she has asserted that she has solemnized her marriage with the petitioner out of her own sweet will, this Court is inclined to accede to the prayer made on behalf of the petitioner for grant of bail.
Patna High Court Cr.Misc. No.24182 of 2016 (2) dt.01-06-2016 Let the above named petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Sri K. L. Yadav, learned Judicial Magistrate, 1st Class, Nawadah in connection with Nardiganj P.S. Case No. 124 of 2015.
