The petitioner being the husband of the complainant is languishing in custody since 19.04.2016 in a case registered for the offences punishable under sections 498A, 379 of the Indian Penal Code and 3 of the Dowry Prohibition Act. Basic accusation is of torture for non-fulfillment of dowry demand.
It is submitted by learned counsel for the petitioner that the petitioner admits his marriage with the complainant and it is the complainant who herself deserted the petitioner but the petitioner is still ready to keep the complainant as wife with dignity and honour. A statement to that effect has been made in paragraph 7 of the petition, which reads as follows :-
Patna High Court Cr.Misc. No.22594 of 2016 (2) dt.19-05-2016 2/2 "That the petitioner is husband of the complainant and is ready to keep the complainant with honour....". Considering the nature of accusation and the present stand of the petitioner, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Jehanabad, in connection with T. R. No. 802/2016 arising out of Complaint Case No.65/2014.
