JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 395 of the Indian Penal Code. The name of petitioner surfaced in this case in confessional statement of co-accused and submission on behalf of the petitioner is that except the confessional statement of coaccused, there is nothing against the petitioner. It is further submitted that so far as recovery of stolen vehicle is concerned, the same has not been recovered from conscious possession of the petitioner.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on
Patna High Court Cr.Misc. No.23693 of 2016 (3) dt.12-07-2016 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Sherghaty, Gaya in connection with Amas P.S. Case No. 189 of 2015.
