Mr. APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 15-12-2021 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Madhepura P.S. Case No. 165 of 2021 dated 24.02.2021 instituted for the offences under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 26.02.2021 and charge-sheet has been submitted in the case.

Learned counsel for the petitioner submits that allegation is of loot of Rs. 51,115/- and Samsung tab by three unknown criminals.

Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.44787 of 2021(2) dt.15-12-2021 2/2 name of the petitioner came in the confessional statement of coaccused Newton Kumar and he has not been put on T.I.P. till date. Learned counsel further submits that confessional statement of the co-accused does not have any evidentiary value in the eyes of law.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 26.02.2021, charge-sheet has been submitted in the case and the name of the petitioner transpired in the confessional statement of co-accused, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Madhepura P.S. Case No. 165 of 2021 subject to the condition as laid down under Section 437 (3) Cr.P.C.
