JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-10-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Taking into consideration that the victim was minor at the time of alleged occurrence and in her statement recorded under section 164 of the Cr.P.C she has stated that she was kidnapped by two persons and after that she was raped by one person out of the aforesaid two persons and furthermore, the victim disclosed the name of this petitioner making allegation against him that he had also participated in her kidnapping, I am not inclined to release the petitioner on bail and accordingly, his prayer for bail in connection with Deokund P.S.Case No. 05 of 2015, pending in the court of learned Judicial Magistrate1st class, Daudnagar stands rejected.
