The petitioner being the husband of the informant is languishing in custody since 28.01.2016 in a case registered for the offences punishable under sections 498A, 494 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act. Basic accusation is of torture for non-fulfillment of dowry demand and performing second marriage.

It is submitted by learned counsel for the petitioner that the petitioner has not performed second marriage. Statement to that effect has been made in paragraph 9 of the petition. The informant is mentally abrased and the petitioner is still ready to keep the informant as wife with full honour and dignity. A statement to that effect has been made in paragraph 13 of the

Patna High Court Cr.Misc. No.22543 of 2016 (2) dt.19-05-2016 2/2 petition, which reads as follows :- "That in spite of all this, and keeping in view the mental health of the informant, the petitioner is still ready to keep the informant with full honour and dignity and is ready to take proper care of her."

Considering nature of accusation and present stand of the petitioner, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Katihar, in connection with Katihar Mahila P.S. Case No.70/2015.
