JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-10-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The occurrence is said to have taken place in the morning of 24.01.2013 but the first information report was lodged on 04.02.2013 and furthermore, it is the case of prosecution that on 30.01.2013 i.e. after six days of the alleged occurrence petitioner and some others were produced before the informant and other villagers by Dr. Prabash Mandal and after that informant claimed to have identified the petitioner. Furthermore, on 03.02.2013, informant gave a petition before the Sarpanch mentioning this fact that petitioner made attempt to commit rape on her and in the aforesaid petition, she has not stated the story of rape.

Patna High Court Cr.Misc. No.30247 of 2015 (3) dt.29-10-2015 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Sabour Goradih P.S. Case No. 25 of 2013.
