JUSTICE MOHIT KUMAR SHAH ORAL ORDER (Per: HONOURABLE MR. JUSTICE RAJAN GUPTA) 01-02-2022 The matter has been heard via video conferencing. The petitioner is aggrieved by the allotment of petrol pump retail outlet in favour of Nirbhesh Kumar (respondent no. 5). According to him, that has been done in an illegal and arbitrary manner. At the outset, a query was put to him whether he has availed the remedy available under the Grievance Redressal Mechanism of the respondent-Corporation. He

Patna High Court CWJC No.10617 of 2020(3) dt.01-02-2022 2/2 submits that he did approach but was ousted on the ground that he had not come within a period of 30 days and besides that he has filed a representation on 18.10.2021 before the concerned District Magistrate.

We thus propose to remit the matter to the Grievance Redressal Mechanism of the respondent-Corporation for considering the grievance of the petitioner on merits without raising any objection regarding delay in approaching it. Learned counsel for the Bharat Petroleum Corporation Limited has no objection.

We thus dispose off the writ petition with the observation that the petitioner shall file appropriate representation within a period of two weeks from today, which shall be decided by the Grievance Redress Forum forthwith, in any case not later than eight weeks. The Grievance Redressal Forum shall also pass a speaking order and convey the same to the petitioner.
