The petitioner seeks regular bail in connection with Kinjer P.S. Case No. 44 of 2020, registered for the offence punishable under sections 307, 504, 506 & other allied Sections of the Indian Penal Code read with Sections 27 of the Arms Act.

The allegation against the accused persons including the petitioner herein is of causing injury to the informant and his family members with farsa, lathi and Danda, apart from some of the accused persons having indiscriminately fired causing firearm injury on the leg of the sister-in-law of the informant.

The learned counsel for the petitioner has

No.45472 of 2021(2) dt.11-01-2022 2/3 submitted that the petitioner is innocent, has been falsely implicated in the present case, is having a clean antecedent and is languishing in custody since 29.12.2020. It is further submitted that there are altogether 15 named accused persons against whom allegation of indiscriminate firing has been levelled as also allegation of having assaulted the members of the prosecution side, has been levelled against the accused persons in a general manner and as far as the petitioner is concerned, he is not alleged to have engaged in any sort of overt act. The learned counsel for the petitioner has next submitted that similarly situated coaccused persons have already been granted bail by the co-ordinate Benches of this Court vide orders dated 30.04.2021 and 28.10.2021 passed in Cr. Misc. No. 8735 of 2021 and Cr. Misc. No. 24651 of 2021, respectively.

Per contra, the learned APP for the State has vehemently opposed the prayer for bail.

Having regard to the facts and circumstances of the case, considering the

No.45472 of 2021(2) dt.11-01-2022 3/3 submissions made by the parties and taking into account the materials available on record as also considering the fact that the petitioner is not alleged to have engaged in any sort of overt act, apart from the fact that similarly situated coaccused persons have already been granted bail by the co-ordinate Benches of this Court, I deem it fit and proper to admit the petitioner to the privilege of regular bail.

Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M.- III/ concerned court, Arwal in connection with Kinjer P.S. Case No. 44 of 2020.
