JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-10-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner was Manager of godown and he was entrusted 22,322.77 quintals paddy to deliver to one Imtiyaz Ahmed who happened to be auction purchaser but petitioner delivered only 15,161.40 quintals paddy to auction purchaser and misappropriated the remaining paddy.
The contention on behalf of the petitioner is that admittedly, rotten and non-eatable paddy had been kept in the godown and therefore, the weight of the aforesaid paddy was bound to be decreased. Moreover, petitioner is in jail custody since 25.02.2015 and the investigation has already been completed.
Patna High Court Cr.Misc. No.32250 of 2015 (4) dt.30-10-2015 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhubani in connection with Pandaul P.S. Case No. 01 of 2015.
