The petitioner seeks bail in a case registered for the offence punishable under Sections 420, 467, 468, 471, 196, 197, 198, 199, 201 & 120-B of the Indian Penal Code. The petitioner who happens to be Panchayat Secretary of Griagaon is said to have appointed Rinki Kumari as Panchayat Teacher on the basis of forged academic certificate and admit card in collusion with the then Mukhiya Saraswati Devi. It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. The petitioner has committed no offence and has no concern with the aforesaid

Patna High Court CR. MISC. No.33309 of 2019(3) dt.23-05-2019 2/2 occurrence. He has been falsely implicated in this case. As a matter fact, it is the Block Development Officer who has to make verification of the academic certificates furnished by the candidates and after verification of the same and forwarding by the B.D.O., the petitioner appointed the said Rinki Kumari as Panchayat Teacher. He happens to be only appointing authority and the admit card was issued by the Panchayat Niyojan Samiti and not by the petitioner. The petitioner has been languishing in custody since 01.04.2019.

Learned APP for the State opposed the bail petition. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Konch P.S. Case No.293 of 2018.
