The petitioner has preferred this application for grant of regular bail in a case registered under sections 20(b)(ii)C, 22, 25, 27(A) and 29 of the NDPS Act.
As per the prosecution case, 10.27 grams of heroin was recovered from the possession of the petitioner. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No incriminating article has been recovered from his possession. He is in custody since 1.3.2021 and has no criminal antecedent under the NDPS Act.
Heard learned A.P.P. for the State.
As per the FSL report received, the substance recovered from the possession of the petitioner has been found to be
Patna High Court CR. MISC. No.44730 of 2021(4) dt.22-03-2022 2/2 Mono Acetyl Morphine.
Having heard learned counsel for the parties and in view of the facts and circumstances of the case, the allegation in the FIR together with the contents of the FSL report, the Court is not inclined to enlarge the petitioner on bail and the application is rejected.
Learned trial Court is directed to expedite the trial. Liberty is granted to the petitioner to renew his prayer for bail after framing of charge.
