====================================================== CORAM: HONOURABLE MR. JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-07-2019 Heard learned counsel appearing for the applicants on restoration petition filed on behalf of the applicants for
Patna High Court MJC No.2839 of 2017(3) dt.03-07-2019 2/2 restoration of F.A. No. 185 of 2011 to its original number as the aforesaid F.A. No. 185 of 2011 stood dismissed due to noncompliance of order dated 3.4.2017 in time. Learned counsel appearing for applicants submits that vide order dated 3.4.2017, the applicants were directed to file necessary requisites for issuance of notices to newly added respondents within four weeks from 3.4.2017 but, unfortunately, the notices could not be filed within the time as framed by this Court. It is pointed out that the notices were filed two days after expiry of period as fixed by this Court. In view of the aforesaid fact as well as submission, this petition is allowed and, accordingly, F.A. No. 185 of 2011 is restored to its original number and the office is directed to proceed in F.A. No. 185 of 2011 in accordance with order dated 3.4.2017.
In the aforesaid manner, this petition stands disposed of.
