2. The petitioner seeks regular bail in connection with Sadar Hajipur P.S. Case No. 147/2023 lodge on 06.03.2023 under Section 147/148/149/353/307/34 of the Indian Penal Code.

3. As per the prosecution case, F.I.R. has been lodged against 5 named and 3-4 unknown accused persons including the present petitioner with an allegation that they have done indiscriminate firing with pistol and thrown bomb on the house of one Surendra Thakur.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel further submits that there is general and omnibus allegation

The criminal antecedent of the petitioner is not clean and there are 12 cases pending against him in which he is on bail is some case and in some he is persuading for bail. The petitioner is in custody since 26.05.2023. He further submits that chowkidar of the locality has identified the accused person and specifically alleged that he being the member of criminal mob and he only thrown bomb and made firing indiscriminately on the house of the Surendra Thakur.

5. Learned APP for the State opposes the prayer for bail and submits that it is the petitioner against whom there is an allegation of throwing bomb and firing indiscriminately. It has also been alleged that they have also fired upon the informant who anyhow saved his life.

6. In the present facts and circumstances of this case and the submissions made above, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, the bail application of the petitioner is hereby rejected.
