The petitioner seeks bail in connection with Bath P.S. Case No. 120 of 2024 instituted for the offence under Sections 406, 420, 467, 468, 471 & 34 of the Indian Penal Code. 3.

As per the prosecution case, FIR has been lodged against four named accused persons, including the petitioner, with the allegation that the seller fraudulently sold the informant's land to four buyers by a common sale deed No. 5469, by which the vendor sold the land. They obtained mutation on the basis of a fake Kewala in Sultanjganj Circle Office.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 25-02-2025. Petitioner bears one criminal antecedent, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. There is no any specific allegation against the petitioner. Petitioner had purchased the land from Sadanand Prasad Verma on his assurance after paying consideration money to him, who is co-sharer of the informant. Learned counsel further submits that petitioner being a purchaser is one of the victims in this case. Similarly situated co-accused has been granted anticipatory bail by a Co-ordinate Bench of this Court vide order dated 23-07-2025, passed in Cr. Misc. No. 31354 of 2025. 6.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. Charge sheet has already been submitted in this case. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, claim based on parity and charge sheet being submitted, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing
