JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-08-2019 This application, for grant of anticipatory bail, arises out of Belhar P.S. Case No. 298 of 2018, disclosing offences under Sections 302/34 of the Indian Penal Code. Prosecution case is that husband of the informant had gone to deliver milk to one Ramji Manjhi and the villagers on the pretext that the husband of the informant entered inside the house with ulterior motive caught him and eleven persons including petitioner started assaulting him lathi and danda and fists and slaps causing injury to him, for which he was first treated at Primary Health Centre thereafter, he was referred to Mayaganj Bhagalpur for better treatment and, thereafter he was
Patna High Court CR. MISC. No.34642 of 2019(3) dt.21-08-2019 2/2 referred to Patna but on the way he died.
Submission of learned counsel for the petitioners is that no specific allegation has been attributed to them and they have falsely been implicated in this case and as the husband of the informant had entered inside the house of the Ramji Manjhi, villagers caught him and assaulted him.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Belhar P.S. Case No. 298 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) sunilkumar/- U T
