2. Heard learned counsel for the petitioner and learned A.P.P. for the State.

3. The petitioner seeks regular bail in connection with Rajoun P.S. Case No. 510 of 2022 registered on 05.11.2022 lodged under Sections 304(B)/34 of the I.P.C.

4. As per the prosecution case, F.I.R. has been lodged against six named accused persons including the present petitioner.

5. Counsel for the petitioner submits that petitioner is the nandoshi (brother-in-law) of the deceased and he is not residing at the house, where the allegation of occurrence took place. He further submits husband is already in custody.

6. Counsel further submits that petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since 06.02.2023 having two criminal cases pending against him, in which he is on bail.

7. Learned counsel for the State opposes the prayer for bail.

8. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Rajoun P.S. Case No. 510 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

9. With this observation, the bail application stands allowed.
