2. The petitioner seeks regular bail in connection with Jakkanpur P.S. Case No. 1005 of 2025, registered under Sections 64(1), 351(3), 352, 61(2) (b) of the B.N.S.

3. As per prosecution case, the allegation is that the petitioner is the photographer who edited the photos of the lady and thereafter after showing her edited photograph he took her to a rented house where he sexually exploited her and thereafter kept on exploiting her. He states that his family members also used to pressurize her to marry with the petitioner and used to threatened her with publication of her objectionable photograph.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the

Patna High Court CR. MISC. No.34900 of 2026(2) dt.20-05-2026 2/3 present case. Counsel for the petitioner further submits that the victim is a married lady and she was in a relationship with the petitioner. Petitioner has clean antecedent and he is in custody since 23.12.2025.

5. Learned APP for the State has vehemently opposes the prayer for bail of the petitioner.

6. That there seems to be continuity of relationship. Moreover, no photograph is there on record to substantiate the claim of the informant. The petitioner has no antecedent. This bail application is allowed.

7. Accordingly, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Judge (Rape and POCSO Act), Patna/concerned court below in connection with Jakkanpur P.S. Case No. 1005 of 2025.

8. However, if the informant comes up with a single objectionable photograph with proof of its publication on the internet, the bail bond of the petitioner shall be immediately cancelled.

9. It is made clear that any observation made herein is

Such observations shall not be construed as an expression on the merits of the case and shall not influence the trial or any other proceedings in any manner.
