JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State.
Petitioner is said to have provided SIM to co-accused Gautam Kumar Kuku. Subsequently, he gave the aforesaid SIM to another co-accused Ravish Kumar and, allegedly, the aforesaid SIM was used in committing the present crime. Moreover, coaccused Gautam Kumar Kuku and several others have already been granted privilege of bail by a co-ordinate Bench of this Court. So far as the present stage of trial is concerned, it appears from the report of the learned 1st Additional Sessions Judge, Chapra, that out of 13 proposed prosecution witnesses, only 8 prosecution witnesses could be examined. Therefore, the aforesaid report goes to show that there is no likelihood of conclusion of
Patna High Court Cr.Misc. No.23940 of 2016 (3) dt.13-07-2016 2/2 trial of the petitioner in near future.
Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge, Chapra in connection with Nayagaon P.S.Case No. 111 of 2013 / Session trial no. 283 of 2014/ 346 of 2014.
