2. The petitioner seeks regular bail in connection with Mahua P.S. Case No. 210/2021 lodged on 24.03.2021 under Section 395 of the Indian Penal Code.

3. As per the prosecution case, F.I.R. has been lodged against six unknown accused persons against whom there is an allegation that they have looted Rs. 1,50,000/- from the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel also submits that that the name of the petitioner has been figured in this case only by virtue of confessional statement of the accused namely Md. Sarfaraj @ prince Raja. Counsel further

Patna High Court CR. MISC. No.37934 of 2024(2) dt.10-07-2024 2/2 submits that the criminal antecedent of the petitioner is not clean and there are 12 cases pending against him in which he is on bail in some case and is some he is persuading for bail. The petitioner is in custody since 31.08.2023.

5. Learned APP for the State opposes the prayer for bail and submits that Aadhar Card of the petitioner was recovered from the house of the accused person who has disclosed the name of the petitioner, therefore, his statement before the police may not be discarded.

6. In the present facts and circumstances of this case and the submissions made above, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, the bail application of the petitioner is hereby rejected.
