JUSTICE GOPAL PRASAD ORAL ORDER 16-06-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 341, 323, 324, 307, 379, 504/34 of the Indian Penal Code and section 3(i)(x) S.C./S.T. Act.

The allegation against the petitioner is that he abused the informant by calling his caste name. It is also alleged that the accused persons assaulted the informant with leg, fists and slaps as a result of which, the informant sustained injury in his whole body. It is also alleged that co-accused Kanhaiya Prasad also snatched Rs. 20,000/- from the pocket of the informant. Learend counsel for the petitioner submits that there

Patna High Court Cr.Misc. No.24098 of 2016 (2) dt.16-06-2016 2/2 is general and omnibus allegation against the petitioner and no offence under Section 307 of the Indian Penal Code is made out against the petitioner as well as Section 3(i)(x) of S.C/S.T. Act and the same has been added only to make the offence serious in nature.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on anticipatory bail in the event of arrest of surrender before the learned Court below within a period of four weeks from the date of receipt of the order on furnishing bail bond of Rs. 10,000/- (ten Thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M. Sitamarhi in connection with Sitamarhi S.C./S.T P.S. Case No. 29 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
