2. The present writ petition has been preferred for the following relief(s):
for issuance for of order/orders, direction/directions commanding the respondents in the nature of certiorari or other appropriate writ/writs for setting aside
Patna High Court CWJC No.4092 of 2017(3) dt.15-09-2025 2/3 order dated 24.09.2016 passed in Miscellaneous Case No.2/2016-17 whereby and whereunder petition dated 12.05.2016 filed by petitioner was rejected the on ill motive ground and further for setting aside the notice dated 16.12.2016 issued Acquisition Case in Land which No.
01/31/12-13 itself shows its ill motive by which Land Acquisition Officer without hearing to the petitioner sent a notice of section 30 of the Act 2013 in which it clearly mentioned that on 15.12.2016 or before any working day the petitioner may received awarded amount of Rs.4,77,897/- but this letter was given on 16.12.2013 and but this Notice was not forwarded owners and amount 22.12.2016.
3. The affidavits have come supporting the order passed by the Collector, Bhojpur, Ara dated 24.09.2016 in Misc. Case No. 02 of 2016-17.
4. Mr. Nadim Seraj has taken this Court to paragraph 20 of the counter affidavit filed on behalf of respondent no. 5 to show that the bypass road already stands constructed and the raiyatts have been paid the due compensation amount which they accepted without any objection.
5. The counter affidavit was served upon the learned counsel for the petitioner in the year 2017 and there is no
Patna High Court CWJC No.4092 of 2017(3) dt.15-09-2025 3/3 rebuttal to it.
6. However, since there is no appearance, the writ petition is dismissed for non prosecution.
