The petitioner seeks bail in anticipation of his arrest in connection with Sandesh P.S. Case No. 99 of 2020 dated 10.04.2020 instituted for the offences under Sections 269, 270, 188 and 34 of the Indian Penal Code, Section 30(a) of the Bihar Prohibition Excise Act and under Section 3 of the Epidemic Disease Act. According to the prosecution report, 20 litres of liquor is said to have been recovered from near the house of one Vijay Singh. The petitioner is alleged to have run away from the place of raid.

The accusation in the FIR is that the petitioner and Vijay Singh deal in liquor trade.

Patna High Court CR. MISC. No.33700 of 2020(2) dt.18-03-2021 2/2 Learned counsel for the petitioner has submitted that an absolutely false accusation has been made against him. There is no recovery from him and he is a person of clean antecedents.

Considering the aforenoted aspects of the matter, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, on his furnishing bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 4th Additional Sessions Judge- cum- Special Excise Act in connection with Sandesh P.S. Case No. 99 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Ashutosh Kumar, J) krishna/- U T
