The petitioner is languishing in custody since 14.12.2013 in a case registered for the offences punishable under Sections 302/34 and 120B of the Indian Penal Code. It is alleged that the petitioner throttled the brother of the informant by putting towel around his neck. It is submitted by learned counsel for the petitioner that the petitioner has maliciously been roped in the present case whereas it is submitted by learned counsel for the State that the accusation is being corroborated by post-mortem report, which suggests the death by throttling. Considering the nature of accusation, this

Patna High Court Cr.Misc. No.12761 of 2015 (03) dt.26-06-2015 2/2 Court is not inclined to grant bail to the petitioner in connection with Dalsingsarai P.S. Case No. 447 of 2013 pending in the court of learned Additional Chief Judicial Magistrate, Dalsingsarai, District - Samastipur.

Accordingly, the prayer for bail of the petitioner is rejected.
