The petitioner seeks bail in a criminal prosecution registered under Section 302/34 of the Indian Penal Code. Taking into consideration the fact that the petitioner is specifically named in the FIR vide Annexure-1 as an accused and she is alleged to be main culprit causing instantaneous death on the spot of the deceased, who was non-else but the mother of the own daughter-in-law of the petitioner, this Court is not inclined to accede to the prayer made on behalf of the petitioner for grant of bail at this stage. Accordingly, her prayer for bail in connection with G.R.No.370 of 2016, arising out of Kotwali P.S. Case No.59 of 2016 pending in the court of learned Chief Judicial Magistrate, Munger is rejected for the present.
However, the petitioner shall be at liberty to renew her prayer for bail on completion of one year in the judicial custody, if the trial of the petitioner is not concluded within the aforesaid period of one year.
