In this case, the petitioner is seeking regular bail in connection with Bihta P.S. Case No. 334 of 2014, registered for the offence under Sections 302, 379/34 of the Indian Penal Code.

This Court vide order dated 21.12.2020 had called for the status report regarding stage of trial. In pursuance of the said order, the Additional District & Sessions Judge-I, Danapur (Patna) sent a letter dated 04.01.2021, wherein it has been mentioned that the case is at argument stage and it is likely to be concluded within two months if the learned counsels for the parties will co-operate.

Patna High Court CR. MISC. No.35416 of 2020(3) dt.18-01-2021 2/2 In such view of the matter, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected.

However, this Court directs the Court below to conclude the trial within three months from the date of receipt / production of a copy of this order. If the trial is not concluded within three months, the Court below will inform the same to this Court with reasons.

However, if the trial is not concluded within six months from the date of receipt / production of a copy of this order, the petitioner will be at liberty to renew the prayer for bail.
