Petitioner is in custody in connection with Kankarbagh P.S.Case No.295 of 2013 registered for an offence under Sections 392, 411 and 401 of the IPC.

The earlier bail application of the petitioner was rejected vide Cr.Misc.No.20914 of 2014 dated 24.09.2014. This is the second attempt for grant of regular bail on behalf of the petitioner. Petitioner is in custody since 09.07.2013, i.e., for more than three years. He has falsely been implicated in the present case due to previous enmity.

A report from the trial Court was called for, the same is kept at flag-'C'. The other co-accused has been granted bail by

Patna High Court Cr.Misc. No.38836 of 2015 (7) dt.01-08-2016 this Court vide Cr.Misc.No.12032 of 2014.

On behalf of the State, it is submitted that the petitioner is named in the FIR.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Ist Class, Patna in connection with Kankarbagh P.S.Case No.295 of 2013.
