Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 25(1B)a, 26, 35 of the Arms Act. It is alleged that on receiving information a raid was laid when few persons were apprehended with arms, but some of them escaped from the scene. The apprehended accused persons disclosed the name of escaped persons including the petitioner.
It is submitted by the learned counsel for the petitioner that there is no recovery from the possession of the petitioner and only on confession of apprehended accused persons the petitioner has been roped in the present case. Though, the petitioner is accused in one other
Patna High Court Cr.Misc. No.24112 of 2016 (2) dt.30-05-2016 case for similar nature.
Let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Buxar Town P.S. Case No. 155 of 2016, pending in the court of learned Shri Hari Shankar, Chief Judicial Magistrate, Buxar.
With the above observation this application is disposed of.
