The petitioner seeks bail in anticipation of his arrest in connection with Kalyanlpur P.S. Case No. 184 of 2020 instituted for the offences under Sections 47, 30(a) and 41(2)(1) of the Bilhar Prohibition and Excise Act, 2016. 675 litres of liquor is stated to have been recovered from a pick-up van. One person by the name of Pintu Kumar was arrested. The prosecution of the petitioner in the present case is on the basis of confession of aforesaid Pintu Kumar. Nothing has been recovered from the

No.33628 of 2020(2) dt.15-03-2021 2/2 possession of the petitioner and except for the confession of aforesaid Pintu Kumar, an arrested accused person, there is no other material to connect the petitioner with the offence. Considering the aforesaid facts and the clean antecedents of the petitioner, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ADJ-II-cum-Special Judge, Excise, Samastipur, in connection with Kalyanlpur P.S. Case No. 184 of 2020, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
